It is well known that there is no Shari\u2019 before the coming of the Shari\u2019, and the origin is the quittance from the (Shari\u2019) responsibility. At the time of revelation, Muslims were in front of rulings that had been legislated and the Shariah expounded their ruling as being permissible (Halal) or forbidden (Haram), where a Muslim would perform these actions based on the legislation and he will be held accountable for them. And there are actions and things for which legislation had not yet been expounded until it (the legislation) was completed, and this is what the Messenger (saw) intended by saying, \u00ab&#8230;<strong>\u0648\u064e\u0645\u064e\u0627 \u0633\u064e\u0643\u064e\u062a\u064e \u0639\u064e\u0646\u0652\u0647\u064f \u0641\u064e\u0647\u064f\u0648\u064e \u0639\u064e\u0641\u0652\u0648\u064c<\/strong>\u00bb\u00a0<strong>\u201cAnd what he was silent about is a pardon\u201d,<\/strong>\u00a0meaning was silent about its legislation. It is a pardon, that is, a Muslim is not held accountable for it, whether he performs or abstains from the action. Because the Sharia contains all the verdicts pertaining to things and actions, so there is no action or thing that does not have a verdict or a place of verdict. A Muslim must ask and search for the ruling on every action he wants to do, contrary to what the Muslims were doing at the time of revelation.<\/p>\n<p>Our beloved Sheikh, is this considered a correct understanding? Knowing that I adopt what is found in our book,\u00a0The Islamic Personality, Volume 3, and I do not stray at all from it, Allah willing.<\/p>\n<p><strong>Answer:<\/strong><\/p>\n<p>Wa Alaikum Assalam wa Rahmatu Allahi wa Barakatuh,<\/p>\n<p>It seems that there is a paragraph about which you got confused, which is your statement in the question: (And there are actions and things for which legislation had not yet been expounded until it (the legislation) was completed, and this is what the Messenger (saw) intended by saying, \u00ab&#8230;<strong>\u0648\u064e\u0645\u064e\u0627 \u0633\u064e\u0643\u064e\u062a\u064e \u0639\u064e\u0646\u0652\u0647\u064f \u0641\u064e\u0647\u064f\u0648\u064e \u0639\u064e\u0641\u0652\u0648\u064c<\/strong>\u00bb\u00a0<strong>\u201cAnd what he was silent about is a pardon,\u201d<\/strong>\u00a0meaning was silent about its legislation. It is a pardon, that is, a Muslim is not held accountable for it, whether he performs or abstains from the action. The Prophet (saw) forbade asking and researching things about which no legislation was revealed so that Allah would not make it tight on Muslims because of the question).<\/p>\n<p>The phrase \u00ab&#8230;<strong>\u0648\u064e\u0645\u064e\u0627 \u0633\u064e\u0643\u064e\u062a\u064e \u0639\u064e\u0646\u0652\u0647\u064f \u0641\u064e\u0647\u064f\u0648\u064e \u0639\u064e\u0641\u0652\u0648\u064c<\/strong>\u00bb\u00a0<strong>\u201cAnd what he was silent about is a pardon\u201d,<\/strong>\u00a0does not mean that its Shari\u2019 ruling was not revealed, rather it means that this matter about which the Messenger (saw) remained silent is permissible [Halal], i.e. permissible [Mubah] if the matter is a thing, or obligatory [Fardh], recommended [Mandub], permissible [Mubah], and reprehensible [Makruh], if it is an action&#8230; We explained this in our answer to a similar question on the 20th Jumada al-Thani 1434 AH corresponding to 05\/05\/2013 CE, and I will mention to you below from the answer what is related to this issue:<\/p>\n<p>[1. The relevant hadiths are:<\/p>\n<p>A. What al-Tirmidhi narrated from Salman al-Farisi who said: The Prophet (saw) was asked about ghee, cheese and fur. Tirmidhi and Daraqutni\u2019s hadith on the authority of Ali (ra): When this Ayah was revealed:<\/p>\n<p>(<strong>\u0648\u064e\u0644\u0650\u0644\u0651\u064e\u0647\u0650 \u0639\u064e\u0644\u064e\u0649 \u0627\u0644\u0646\u0651\u064e\u0627\u0633\u0650 \u062d\u0650\u062c\u0651\u064f \u0627\u0644\u0652\u0628\u064e\u064a\u0652\u062a\u0650 \u0645\u064e\u0646\u0650 \u0627\u0633\u0652\u062a\u064e\u0637\u0627\u0639\u064e \u0625\u0650\u0644\u064e\u064a\u0652\u0647\u0650 \u0633\u064e\u0628\u0650\u064a\u0644\u0627\u064b<\/strong>)<strong>\u00a0\u201cAnd [due] to Allah from the people is a pilgrimage to the House &#8211; for whoever is able to find thereto a way.\u201d<\/strong>\u00a0They said: \u201cEvery year, Oh Messenger of Allah (swt)?\u201d He (saw) was silent, so they said: \u201cEvery year?\u201d He said:<\/p>\n<p>\u00ab<strong>\u0644\u064e\u0627 \u0648\u064e\u0644\u064e\u0648\u0652 \u0642\u064f\u0644\u0652\u062a\u064f \u0646\u064e\u0639\u064e\u0645\u0652 \u0644\u064e\u0648\u064e\u062c\u064e\u0628\u064e\u062a\u0652<\/strong>\u00bb\u00a0<strong>\u201cNo, and if I said yes then it would become obligatory\u201d<\/strong>\u00a0And Allah (swt) revealed:<\/p>\n<p>(<strong>\u064a\u0627 \u0623\u064e\u064a\u0651\u064f\u0647\u064e\u0627 \u0627\u0644\u0651\u064e\u0630\u0650\u064a\u0646\u064e \u0622\u0645\u064e\u0646\u064f\u0648\u0627 \u0644\u0627 \u062a\u064e\u0633\u0652\u0626\u064e\u0644\u064f\u0648\u0627 \u0639\u064e\u0646\u0652 \u0623\u064e\u0634\u0652\u064a\u0627\u0621\u064e \u0625\u0650\u0646\u0652 \u062a\u064f\u0628\u0652\u062f\u064e \u0644\u064e\u0643\u064f\u0645\u0652 \u062a\u064e\u0633\u064f\u0624\u0652\u0643\u064f\u0645\u0652<\/strong>)<\/p>\n<p><strong>\u201cO you who have believed, do not ask about things which, if they are shown to you, will distress you.\u201d<\/strong>\u00a0To the end of the verse.<\/p>\n<p>And in another narration by Daraqutni on the authority of Abu Hurayra, he said that Allah\u2019s Messenger (saw) said:<\/p>\n<p>\u00ab<strong>\u064a\u064e\u0627 \u0623\u064e\u064a\u0651\u064f\u0647\u064e\u0627 \u0627\u0644\u0646\u0651\u064e\u0627\u0633\u064f \u0643\u064f\u062a\u0650\u0628\u064e \u0639\u064e\u0644\u064e\u064a\u0652\u0643\u064f\u0645\u064f \u0627\u0644\u0652\u062d\u064e\u062c\u0651\u064f<\/strong>\u00bb\u00a0<strong>\u201cO people, Allah has made the hajj obligatory for you.\u201d<\/strong>\u00a0A man got up and said, \u2018Every year, Messenger of Allah?\u2019 He turned away from him, then the man repeated and said \u201cEvery year Oh Messenger of Allah (swt)?\u201d So he said: \u00ab<strong>\u0648\u064e\u0645\u064e\u0646\u0650 \u0627\u0644\u0652\u0642\u064e\u0627\u0626\u0650\u0644\u064f\u00bb<\/strong>\u061f\u00a0<strong>\u201cWho is that who asks?\u201d<\/strong>\u00a0So they said:<strong>\u00a0\u201cThis person,\u201d<\/strong>\u00a0and he said:<\/p>\n<p>\u00ab<strong>\u0648\u064e\u0627\u0644\u0651\u064e\u0630\u0650\u064a \u0646\u064e\u0641\u0652\u0633\u0650\u064a \u0628\u0650\u064a\u064e\u062f\u0650\u0647\u0650 \u0644\u064e\u0648\u0652 \u0642\u064f\u0644\u0652\u062a\u064f \u0646\u064e\u0639\u064e\u0645\u0652 \u0644\u064e\u0648\u064e\u062c\u064e\u0628\u064e\u062a\u0652 \u0648\u064e\u0644\u064e\u0648\u0652 \u0648\u064e\u062c\u064e\u0628\u064e\u062a\u0652 \u0645\u064e\u0627 \u0623\u064e\u0637\u064e\u0642\u0652\u062a\u064f\u0645\u064f\u0648\u0647\u064e\u0627 \u0648\u064e\u0644\u064e\u0648\u0652 \u0644\u064e\u0645\u0652 \u062a\u064f\u0637\u0650\u064a\u0642\u064f\u0648\u0647\u064e\u0627 \u0644\u064e\u0643\u064e\u0641\u064e\u0631\u0652\u062a\u064f\u0645\u0652<\/strong>\u00bb<\/p>\n<p><strong>\u201cBy He who my soul is in his hand, if I had said yes then it would be obligatory and if it was obligatory then you would not handle it and if you were not able to handle it then you would disbelieve.\u201d<\/strong><\/p>\n<p>So Allah (swt) revealed the Ayah,<\/p>\n<p>(<strong>\u064a\u064e\u0627 \u0623\u064e\u064a\u0651\u064f\u0647\u064e\u0627 \u0627\u0644\u0651\u064e\u0630\u0650\u064a\u0646\u064e \u0622\u0645\u064e\u0646\u064f\u0648\u0627 \u0644\u0627 \u062a\u064e\u0633\u0652\u0626\u064e\u0644\u064f\u0648\u0627 \u0639\u064e\u0646\u0652 \u0623\u064e\u0634\u0652\u064a\u0627\u0621\u064e \u0625\u0650\u0646\u0652 \u062a\u064f\u0628\u0652\u062f\u064e \u0644\u064e\u0643\u064f\u0645\u0652 \u062a\u064e\u0633\u064f\u0624\u0652\u0643\u064f\u0645<\/strong>)<\/p>\n<p><strong>\u201cO you who have believed, do not ask about things which, if they are shown to you, will distress you.\u201d<\/strong><\/p>\n<p>2. Before delving into their meanings it would be good to refer to some necessary points:<\/p>\n<p>A. The differentiation between \u201cthing and action\u201d is a question of Usul ul-fiqh [the foundations of Islamic Jurisprudence] and not a linguistic question. Otherwise, saying a thing would include the action, and as such classify the Hukm Shari\u2019 as fard [obligatory], and wajib [obligatory], mandub [recommended], mubah [permissible], makruh [reprehensible], haram [prohibited], manthoor, and rukhsa [permit], \u2018azeema, shart [condition], sabab [cause], mani\u2019, sahih, fasid, batil&#8230; these are terms of Usul ul-fiqh, so if you opened a linguistic dictionary for their meanings you would not find the meaning according to the Usul ul-fiqh.<\/p>\n<p>And these terms of the foundations of Islamic jurisprudence originated after the time of the Messenger (saw) and the Righteous Caliphs (Khulafaa\u2019 ar-Rashideen), like the grammatical terminology (subject and object)&#8230; so if we look in a linguistic dictionary we would find its meaning different from the conventional grammatical meaning.<\/p>\n<p>B. Therefore, if you read a hadith of the Messenger (saw) or his companions (ra) and find the word \u201cthing\u201d or the word \u201csubject\u201d, that does not mean the same in conventional terminology, so one must study it to see its correct significance where it falls: Is it a linguistic reality, or a special custom \u201cconvention\u201d, or a Shar\u2019i reality.<\/p>\n<p>C. If the question is about particular phrases, and the answer was general independent of the question, then the generality is in the topic of the question that the answer addresses, and not specific to the phrases that are found in the question, for example the Sahih hadith that Tirmidhi related through Abu Sayeed al-Khudri, he said: It was said: Oh the Messenger of Allah (saw), Can we perform ablution out of the well of Buda\u2019ah&#8230;? This applies to everything that falls under \u201cthing or action\u201d according to the conventional meaning, because if it applies to a thing, then halal here means \u201cpermissible\u201d, and if it is applies to an action, then halal here is what is not haram, in other words what is \u201cfard, mandub, mubah, makruh.\u201d<\/p>\n<p>b. As for the prohibition on questioning, it is the case when the Messenger (saw) is asked about something and he answers or remains silent. If he answers than it means he expounded the hukm expressly, and if he does not answer or remains silent than it means that he has expounded that that thing or action its hukm is that it is halal. Thus no hukm can be given except on the basis of an evidence, just as no hukm can be given except after the coming of the shari\u2019. The \u2018asl, then, is to search for the hukm in the shar\u2019, that is, the \u2018asl is to search for the shar\u2019i evidence for a shar\u2019i hukm from the shar\u2019.)<\/p>\n<p>Therefore, it is forbidden for a Muslim to ask about an issue in which the Messenger (saw) has expounded its ruling and not to be satisfied by that, but to go too far in the question.
