{"id":3752,"date":"2025-07-30T21:24:56","date_gmt":"2025-07-30T18:24:56","guid":{"rendered":"https:\/\/hizbke.org\/sw\/?p=3752"},"modified":"2025-07-30T21:24:56","modified_gmt":"2025-07-30T18:24:56","slug":"3752-2","status":"publish","type":"post","link":"https:\/\/hizbke.org\/sw\/3752-2\/","title":{"rendered":""},"content":{"rendered":"<p><!--more--><\/p>\n<p><strong><u>URITHI KATIKA UISLAMU<\/u><\/strong><\/p>\n<p><strong><u><b>Sehemu ya kwanza<\/b><\/u><\/strong><\/p>\n<p><strong><u><b>WARITHI HALALI KATIKA UISLAMU<\/b><\/u><\/strong><\/p>\n<p><strong><em><i>(Kwa mujibu wa Qur&#8217;an na Sunnah)<\/i><\/em><\/strong><\/p>\n<p>Katika Uislamu, <strong><b>mirathi (urithi)<\/b><\/strong>\u00a0ni haki inayotolewa na Allah kwa baadhi ya jamaa wa karibu wa marehemu. Qur&#8217;an na Hadith zimeweka <strong><b>masharti maalum<\/b><\/strong>\u00a0kuhusu nani anastahili kurithi na kwa kiasi gani. Warithi halali ni wale ambao wameainishwa wazi na sheria ya Kiislamu.<\/p>\n<p><strong><b>Qur\u2019an<\/b><\/strong>: Surah An-Nisaa (4:11, 4:12, 4:176) inaeleza mgawanyo wa urithi.<\/p>\n<p><strong><b>Sunnah<\/b><\/strong>: Mtume \ufdfa alisema: <em><i>&#8220;Mugawanyieni warithi urithi wao waliopangiwa, na kilichobaki kiende kwa wa karibu wa kiume.&#8221;<\/i><\/em>\u00a0(Bukhari na Muslim)<\/p>\n<ol>\n<li><strong><u>(A) Dhaw-u\u2019l-Fara\u2019idh<\/u><\/strong><strong><u><br \/>\n<\/u><\/strong>Hawa ni watu waliopangiwa sehemu maalum ya mali ya marehemu. Wapo watu kumi na wawili: wanaume wanne \u2013 baba, babu, ndugu wa mama (uterine brothers), na mume; na wanawake wanane \u2013 mke, binti wa pekee, mjukuu (binti wa mwana), mama, bibi (yaani mama wa mama au mama wa baba), dada wa baba na mama (full sister), dada wa baba (consanguine sister), na dada wa mama (uterine sister).<\/li>\n<li>Baba hupata sehemu ya sehemu moja ya sita (1\/6) endapo marehemu ameacha mtoto wa kiume au mjukuu wa kiume. Ikiwa hakuna mtoto au mjukuu wa kiume, baba pia huchukuliwa kama &#8216;Asaba na huongezewa sehemu hiyo.<\/li>\n<li>Babu (baba wa baba) ana sehemu kama ya baba lakini kwa masharti matatu:<\/li>\n<li>Kwa mujibu wa Imam Bukhari na Imam Muslim, kuwepo kwa baba kunawanyima hata ndugu wa marehemu haki ya urithi, lakini hii haimhusu babu. Hata hivyo, Imam Abu Hanifa anasema kuwa kuwepo kwa babu kunamnyima ndugu wa marehemu haki ya urithi.<\/li>\n<li>Ikiwa baba wa marehemu yuko hai, mama hupata sehemu iliyobaki baada ya sehemu ya mke kuchukuliwa.<\/li>\n<\/ol>\n<ul>\n<li>Bibi hana sehemu ya urithi endapo baba wa marehemu yuko hai, lakini hupata sehemu iwapo babu yuko hai na baba hayuko.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li>Ndugu wa mama (uterine brothers and sisters): mmoja hupata sehemu ya sita (1\/6), lakini ikiwa wako zaidi ya mmoja hupata sehemu ya tatu (1\/3) kwa pamoja.<\/li>\n<li>Mume wa marehemu hupata nusu (1\/2) ya mali ikiwa mke hana watoto; lakini kama kuna watoto, hupata sehemu ya nne (1\/4).<\/li>\n<li>Mke hupata sehemu ya nne (1\/4) iwapo mume amekufa bila mtoto; lakini kama kuna mtoto, hupata sehemu ya nane (1\/8).<\/li>\n<li>Binti wa pekee hupata nusu (1\/2) ikiwa yuko peke yake, na theluthi mbili (2\/3) ikiwa wako zaidi ya mmoja. Ikiwa kuna mtoto wa kiume, mabinti watakuwa &#8216;Asaba, na mtoto wa kiume atapata mara mbili ya kile anachopata binti. Wajukuu wa kike wanachukua nafasi ya mabinti lakini ikiwa kuna binti mmoja na mjukuu mmoja au zaidi, mjukuu hupata sehemu ya sita (1\/6). Mjukuu wa kike hapati chochote ikiwa marehemu ameacha mtoto wa kiume, lakini kama amewaacha wajukuu wa kiume na wa kike, watagawana kama &#8216;Asaba, na mjukuu wa kiume atapata mara mbili ya wa kike.<\/li>\n<li>Dada kamili (full sister) hupata nusu (1\/2) ikiwa yuko peke yake, na theluthi mbili (2\/3) ikiwa wako zaidi ya mmoja.<\/li>\n<li>Dada wa baba (consanguine sister) anapata nusu (1\/2) akiwa peke yake na theluthi mbili (2\/3) ikiwa wako zaidi.<\/li>\n<li>Mama hupata sehemu ya sita (1\/6) kama kuna mtoto au mjukuu, na sehemu ya tatu (1\/3) ikiwa hana mtoto.<\/li>\n<li>Bibi (yaani mama wa mama au mama wa baba) hupata sehemu ya sita (1\/6) ikiwa yuko mmoja au wote wawili. Bibi wa mama hanyang\u2019anyi urithi ikiwa mama wa marehemu yuko hai, na bibi wa baba hanyang\u2019anyi urithi ikiwa baba yuko hai.<\/li>\n<\/ol>\n<p><strong><u>(B) Asaba (Urithi wa Mabaki)<\/u><\/strong><\/p>\n<p>Baada ya warithi wa kundi la kwanza kupata sehemu zao, kilichobaki kinapewa wale wa ukoo wa karibu wa kiume (Asaba) \u2013 yaani wale ambao hawajaingiliwa na uhusiano wa kike. Asaba hawana mgao maalum. Ikiwa hakuna Dhaw-u\u2019l-Fara\u2019id, basi mali yote huenda kwao. Ikiwa Dhaw-u\u2019l-Fara\u2019id wamepata sehemu zao, kilichobaki hupewa Asaba. Hawa ni miongoni mwa Asaba:<\/p>\n<ol>\n<li>Mwana wa kiume: ndiye anayepata mabaki kwanza. Binti hupata nusu ya sehemu ya mwana wa kiume. Wajukuu wa kiume hawapati chochote ikiwa mwana wa kiume wa marehemu yuko hai. Ikiwa mwana hayuko hai, basi mjukuu wa kiume hupata. Ikiwa kuna zaidi ya mtoto mmoja wa kiume, hugawana sawa.<\/li>\n<li>Baba, babu na babu mkubwa wanahesabiwa pia kama Dhaw-u\u2019l-Fara\u2019id, lakini ikiwa hakuna mwana wa kiume au mjukuu, basi baba huwa &#8216;Asaba. Ikiwa baba hayupo, babu hupewa nafasi hiyo.<\/li>\n<li>Ikiwa hakuna mwana, mjukuu, baba, wala babu, basi ndugu wa kiume huchukua urithi kama Asaba. Ikiwa ndugu hayupo, basi mwana wa ndugu au mjukuu wa ndugu hupokea urithi. Wanaume hupata mara mbili ya wanawake.<\/li>\n<li>Ikiwa hakuna wa hapo juu, basi ndugu wa baba (consanguine brother) anakuwa na haki ya urithi kuliko mwana wa ndugu kamili.<\/li>\n<li>Kisha hufuata mjomba kamili (full paternal uncle).<\/li>\n<\/ol>\n<p><strong><u>(C) Dhaw-u\u2019l Arham (Wenye Mahusiano Kupitia Wanawake)<\/u><\/strong><br \/>\nHili ni kundi la mwisho, na ni nadra sana kupata sehemu ya urithi. Wafuatao wanaingia katika kundi hili:<br \/>\n1. Mwana wa binti na binti wa binti.<br \/>\n2. Mwana wa mjukuu wa kike na binti wa mjukuu wa kiume pamoja na watoto wao.<br \/>\n3. Babu wa mama, babu wa baba upande wa mama, babu wa mama upande wa mama, bibi wa mama, watoto wa dada, dada wa baba na dada wa mama, n.k.<br \/>\nIkitokea hakuna Dhaw-u\u2019l-Fara\u2019id wala Asaba, basi urithi unaweza kurithishwa kwa Dhaw-u\u2019l-Arham kwa mujibu wa masharti ya Fiqh ya Kiislamu.<\/p>\n<p><strong><u>sehemu ya pili<\/u><\/strong><\/p>\n<p>Hali ya Mtoto Aliyedaiwa (al-Mustal\u1e25aq) katika Mirathi ya Kiislamu<\/p>\n<ol>\n<li><strong><u> Maana ya <\/u><\/strong><strong><em><u><i>Istil\u1e25\u0101q<\/i><\/u><\/em><\/strong><\/li>\n<\/ol>\n<p>Istil\u1e25\u0101q ni kitendo cha mwanaume kudai au kukiri kuwa mtoto fulani ni wake na kumjumuisha katika ukoo wake, kwa misingi ya nasaba. Hii hufanyika kwa tamko kama vile: <em><i>\u201cHuyu ni mwanangu.\u201d<\/i><\/em>\u00a0Lengo la istil\u1e25\u0101q ni kuanzisha uhusiano wa kinasaba kati ya mtoto na baba, unaoweza kuathiri haki za mirathi, ukoo na ndoa.<\/p>\n<ol start=\"2\">\n<li><strong> Hukumu ya <\/strong><strong><em><i>Istil\u1e25\u0101q<\/i><\/em><\/strong><strong>katika Fiqhi ya Kiislamu<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Ikiwa mtoto alizaliwa kwa mjakazi halali (ambaye alikuwa chini ya umiliki wa halali wa mwanaume huyo), basi mtoto huyo ni wa halali na anaruhusiwa kurithi.<\/li>\n<li>Ikiwa mtoto alizaliwa kutokana na zinaa, hata kama mwanaume atamkiri kuwa ni wake, hawezi kurithi kutoka kwake wala kutoka kwa ukoo wa mwanaume huyo.<\/li>\n<li>Ikiwa mtoto hana baba mwingine anayejulikana, na mwanaume anakiri kuwa ni wake bila ya kuwa na ushahidi wa zinaa, basi istil\u1e25\u0101q inazingatiwa kulingana na masharti ya madhehebu tofauti.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong> Masharti ya <\/strong><strong><em><i>Istil\u1e25\u0101q<\/i><\/em><\/strong><strong>Ili Mtoto Aweze Kurithi<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Mtoto hana baba mwingine anayetambulika.<\/li>\n<li>Kukiri kumefanyika wakati baba bado yuko hai.<\/li>\n<li>Hakuna ushahidi wa zinaa au dosari ya kisheria.<\/li>\n<li>Kukiri kunafanywa wazi, si kwa kulazimishwa.<\/li>\n<li>Mtoto ni katika umri au mazingira yanayokubalika na sharia ya Kiislamu (mfano: muda wa mimba halali ni kati ya miezi 6 hadi miaka 2 baada ya kuachana au kufariki kwa baba na kurithi ikiwa:<\/p>\n<ul>\n<li>Hana baba mwingine aliyejulikana.<\/li>\n<li>Kukiri kumefanywa wakati mwanaume akiwa hai.<\/li>\n<li>Ikiwa mwanaume amekufa na hakutoa tamko la kukubali kabla ya kifo, istil\u1e25\u0101q haitakubalika.<\/li>\n<\/ul>\n<p>Dalili yao:<br \/>\nHadithi ya Mtume (\ufdfa):<\/p>\n<p><strong><em><i>\u201cAl-walad lil-fir\u0101sh walil-\u2018\u0101hir al-\u1e25ajar<\/i><\/em><\/strong><em><i>\u201d<\/i><\/em><br \/>\n\u201cMtoto ni wa kitanda (ndoa), na kwa mzinifu hana haki.\u201d (Bukhari na Muslim)<\/p>\n<p><strong><u>Madhehebu ya Maliki<\/u><\/strong><\/p>\n<p>Imam Malik anaruhusu istil\u1e25\u0101q ikiwa:<\/p>\n<ul>\n<li>Hakuna ushahidi wa uzinifu.<\/li>\n<li>Mtoto huyo hajatokana na zinaa.<\/li>\n<li>Mtoto wa zinaa hawezi kurithi hata akidaiwa na baba.<\/li>\n<li><strong><em>Wanaangazia sana suala la uhalali wa ndoa na heshima ya nasaba.<\/em><\/strong><\/li>\n<\/ul>\n<p><strong><u>Madhehebu ya Shafi\u2018i<\/u><\/strong><\/p>\n<p>Imam ash-Shafi\u2018i anakubali istil\u1e25\u0101q ikiwa:<\/p>\n<ul>\n<li>Mtoto hana baba mwingine anayejulikana.<\/li>\n<li>Kukiri kunafanywa kwa hiari na hakuna ushahidi wa zinaa.<\/li>\n<li>Sharti la kukiri kabla ya kifo ni muhimu sana.<\/li>\n<li><strong><em>Madhehebu haya yanazingatia zaidi tahadhari ili kulinda usahihi wa nasaba na kuepuka udanganyifu.<\/em><\/strong><\/li>\n<\/ul>\n<p><strong><u>Madhehebu ya Hanbali<\/u><\/strong><\/p>\n<p>Imam Ahmad bin Hanbal anakubaliana na istil\u1e25\u0101q kwa masharti:<\/p>\n<ul>\n<li>Hakuna baba mwingine anayedai uhusiano huo.<\/li>\n<li>Kukiri kunafanywa wazi, na mtoto yuko ndani ya muda unaokubalika (mimba halali).<\/li>\n<li>Kukiri lazima kufanywe mwanaume akiwa hai.<\/li>\n<li>Hili linazingatia pia ushahidi wa kihalali (mfano: ushuhuda, muda wa ujauzito, nk.).<\/li>\n<\/ul>\n<p><strong><u>Uamuzi wa Qadhi (Hakimu wa Kiislamu)<\/u><\/strong><\/p>\n<p>Ikiwa kuna mashaka, Qadhi ana mamlaka ya kutumia ushahidi (pamoja na kisasa kama DNA) kutoa uamuzi juu ya istil\u1e25\u0101q.<\/p>\n<p>Uamuzi wa Qadhi unazingatiwa kuwa wa mwisho katika utekelezaji wa mirathi.<\/p>\n<p><strong>Hitimisho<\/strong><\/p>\n<ul>\n<li>Mtoto wa ndoa au wa mjakazi wa halali: anarithi kwa mujibu wa sheria.<\/li>\n<li>Mtoto wa zinaa: hapati urithi hata kwa kukiriwa.<\/li>\n<li>Mtoto aliyedaiwa: anarithi iwapo masharti ya istil\u1e25\u0101q yatatimizwa.<\/li>\n<li>Masharti haya yanatofautiana kidogo baina ya madhehebu lakini msingi wake unalenga kulinda
